Good Afternoon Everyone-

I want to clear the air a little bit about an email message that
I forwarded to my private distribution list.  The message was
referencing several individuals...Larry Friedman and his law firm,
Dan and Pam Richardson and Bob Guenther.

I want to make sure that everyone is clear that I did not write
that email message.  I forwarded on the information as I received
it.  I believe I referenced this just above my signature where I
stated, "I am sharing it as I received it"

I do what I can to verify if information is correct and then I make
a judgment call as to whether I forward something on to my
private group.  I went through a few steps to confirm the information
that I received and then passed it along to you thinking that I was
providing accurate information.

As it turns out, the majority of the details presented in that message
were not correct.  I want to formally apologize to Larry Friedman and
his law firm and also to Dan and Pam Richardson for forwarding on
the information that I did to my group.

Because I was not the author of the original message I cannot
offer a retraction of what was written, I can only publicly apologize
to them and hope that they will accept my sincere apology for sharing
the information.

In light of the email message that I forwarded to you all, I would
like to encourage you to read the following information as it was
shared with me from both the Richardsons and Larry Friedman, both
of whom I have been in communication with over the last 24 hours.

It is my hope that this will clear up any wrong information that is
floating around in the ASD circles.

Please continue reading below my signature.  Some of the items are
paraphrased due to the sensitivity of the subject matter. 

Also, I would consider it a personal favor if you would share the
correct details with your own personal contacts who might benefit
by knowing this information.

One final request...if anyone knows the original author of the email
that has been distributed would you please forward that information
to me immediately?  Thank you.

Pam Richardson, was never a trustee for the ASDMBA.
 
Dan Richardson resigned as trustee on September 11, 2008. 
He never saw one document relating to the bank account, collected
funds or expenses, nor was he ever involved in any administrative
tasks or decisions.  
 
The Richardsons severed all communication with Bob Guenther on
September 11, 2008 and did not participate in any conference calls after
that.
 
The Richardson's names were removed from the ASDMBA immediately
upon resignation and they have not had any communication with ASD
members regarding the trust or the law firm since September 11, 2008.
 
The Richardsons would greatly appreciate our communication of their UN-
involvement with Bob and the ASDMBA.  They have experienced the same
type of treatment as everyone else, the insults, threats, etc.  
 
The Richardsons do not agree with his tactics, his language, his berating
of people, his insults, his threats or anything else he does at this
point.  They do not want to be associated with him and they do not
appreciate having their names smeared along with him. 

The following was shared with me from attorney Larry Friedman.  At the
time of his writing he was under the impression that I was the original
author of the "Bob Guenther" email that has been circulating.

Third, our firm did not handle the money from the ASDMBA. You
should contact the Trustees to prepare an accounting of the money
collected and how it was spent. The only thing that our firm can
account for is what we billed, what we were paid, and what we are
owed by the ASDMBA.

Fourth, the ASDMBA was our only client and we did what the ASDMBA
asked us to do. Everything we did for the ASDMBA was consistent
with what we were hired to do which was assist the ASDMBA in
recovering money for ASD members who lost money in ASD.

Fifth, we were not hired, nor did we agree, to get involved in the
intramural fighting among the ASD members.  In fact, we specifically
stated that we would not get involved in the fighting by, between
and amongst members.

Sixth, no one from our firm is or was a trustee--period.

Seventh, I have never seen the ASDMBA website. I have never given
our consent to put our firm's name on the ASDMBA website. Our firm
has never published or authorized any statement on the ASDMBA
website. I never gave consent to any statement made by Bob Guenther
or anyone else who put anything on the ASDMBA website.

Eighth, our law firm billed the ASDMBA for the legal work that we did.
We have not been paid for all the services that we have rendered to
the ASDMBA.

Ninth, our firm is not trying to get control of the $80,000,000 that
the Government has seized for our own personal gain nor did we have
a plan to do so. Our only plan was to represent the ASDMBA as we
have done.

Tenth, our position hasn't changed from the beginning of our
representation. We stated that before we would file a lawsuit on
behalf of the ASDMBA we would have to have a $100,000 retainer
for that lawsuit. We have never been given that retainer by the
ASDMBA.

Eleventh, we have no knowledge whether anyone is receiving any
salary from the Trust. That matter would be up to the Board of Directors
of the Trust and the Trustees would have that information.
