Summary Judgement for ASD?

Re: ASD Motions

Having first hand experience in a 6 year civil case against a former US Presidential candidate and one of his companies, I can guarantee all members that the filed motions will not be granted in the companies favor. One must understand that every time the ASD lawyers file a motion, the USAG will file a counter motion which does nothing more than delay the out come. Trust me when I say the USDOJ has a bottomless pit of money when it comes to litigation. This case will drag on for years or until the defendants run out of money. If the ASD lawyers are confident that they are going to prevail in this case, then it would be wise to file for a "Summary Judgement" immediately. If they prevail, all legal fees and expenses would be paid to the defendants. The real question is: Are they ready to go to trial now?

Steve-
I would rather not have my email address posted. The case I referenced took 6 years to get to trial and cost $890,000.00 on our end. We called for a summary judgement after spending a ton on money over a 2 year period. The plaintiffs knowing they were going to lose, dropped the case one day prior to summary judgement. It was a roll of the dice on behalf on my 2 partners and myself. After judgement,we immediately filed a suit againt them for "Abuse of Process & Malicious Prosecution". This battle was fought for 4 years and was finally in trial for a one month period. The deck was stacked against the now defendents and they knew it. Just twenty minutes prior to the jury delivering their decision- the defendents made us an offer we could not refuse and the case was settled. By the way, the jury was about to rule in our favor for $4 million in lost income and $5 million in punitive damages. The point I am stressing is that if the ASD lawyers are confident of the out come- then go for the summary judgement. If not, the legal fees will sky rocket to well over an astronomical amount. I am more than familiar with the Ackerman-Sennerfit law firm. They are big and very costly. I provide this info so that the ASD members do not expect to be back in business or get a refund in the near future.

Hope this answeres you questions. If you would like to speak to me about this issue, I will provide you with my phone number.

Best Regards,
Dick
