Subject: ASD Final Conclusions

Good Evening All-

I hope you are all off to a great weekend!

As Connie and I drove back from our trip today I had the
opportunity to speak with Andy for a bit.  As much as I
wish I could share everything, I can really only say this
for now...Andy sounded "exceptionally positive" about the
future of ASD!

Ok, I want to share the following ASD update with you all.
Some of you may have already seen it from other sources,
but it not, read on...

I want to thank Mark Claessens for putting it together.

Regards,
Robert

Hi Everybody,

I've just received some good links from Cathy with some comments.  I am going to combine them here and re-create the hyperlinks to make life easier. In addition, I am also including both legal docs as pdf files for you if you just want to store them on your computer or read them that w ay. (See
the attachments)

As you know, the emergency hearing for ASD was concluded last week and you received plenty of updates from me.  Both attorneys have now filed their final conclusions for the judge so she can take those into consideration and then make her final determination regarding whether or not she will release our funds and thus allow us to begin advertising, surfing and paying out the rebates as we were 10 weeks ago.

Here are the two links for the final conclusions:

Conclusions filed on behalf of ASD:

Conclusions filed on behalf of the Government:

And here is a message from a guy named Ken with his opinion/spin on what he felt after reading these legal documents.  I recommend not only reading what Ken thinks, but even if you have not yet taken time to read any other legal documents to date, at least read these two.

Enjoy the read and we expect to hear from the judge within 2 weeks (that's what she has asked for).

Mark

This is only my 2 cents worth, I too read both summaries, and I CAN read legalese, the government had absolutely nothing and so the AG had to rehash the same old nonsense, all he did was just change the order of things around a bit hoping to fool the judge into believing he had something. Everything really hinges on the fact that it was not a Ponzi and the AG has already admitted to the fact that it WAS NOT A PONZI. So if you don't have anything then the old saying really applies in this case, "baffle them with bull****", and that is all the AG had, he just wrote and wrote and wrote and didn't say anything because his original premise was gone. I don't think his bull**** is going to baffle this judge. His brief did nothing more than to show just how desperate he is to try to win anything and just how poorly he has performed in presenting his case. When we win this one he will be open for damages. We will prove the hardship and damage his illegal actions did to literally thousands of families across the country.

The ASD brief was absolutely brilliantly written and so well done so that with a few names omitted most of it would be a perfect training manual for ASD so as to explain how the program works. Unless the judge is brain dead or taking a payoff which neither would be true in her case, we are going to win this one. Sleep well, this one is going our way. Believe me I have been around the legal system a bit, and I am not telling myself what I want to hear. Our legal team earned their money and they have a lot of work to do. I DO NOT like attorneys but in this case I will make an exception. They ARE good, they need to be paid NOW, and they have a lot of work to do.
