Summary ASD call with Andy 08-26-08
Tonight on the call Andy started with a note
of appreciation
for all the support, letters and emails he and Faye get
on
a daily basis. Then he spent time responding
to some of the
'less than flattering' insinuations and
allegations made by the
U.S. Attorney
General in the 'Motion of Opposition'.
He said he did expect them to respond
with opposition to the
motion, but he didn't expect them
to lie and use half-truths to
try to make their case.
AG - Andy told us
he modeled ASD after the 12dailypro
company.
Andy - That statement was a big fat lie, I never
said that.
The investigator asked me if I was
a part of 12dailypro and I
told him "no". Then he asked
how I designed the ASD program?
And I told him I had a website and
was learning about the
Internet for almost 2 1/2 years
ago and I started putting the website
on traffic exchanges. That is where
people can go in and become
free members and put up websites,
look at others websites, and
receive credit for doing so.
I experimented with it and it
worked out good. So I started to
think - this is a real good
business model and if we designed it so
we paid members for looking at websites
based on maybe 50%
of the sales, then a lot more people
would get involved and build
a loyal group of advertisers.
Andy Noted: When he said
that he wanted to ask me questions
I told him I did NOT want to
answer questions without an Attorney.
He replied that IF I was running
a legitimate business I would
answer his questions
now, and if I was not, then I would want to
wait for an Attorney. Since
I KNEW I was running a legitimate
business, I talked freely to
them.
I see now how the investigator
tricked me into answering questions
and they were not recorded, so he
could interpret my answers
later and say I said whatever he
chose.
AG - Hinted that the
account in Antigua was to siphon money off of
the
accounts and put them off shore.
Andy - They knew that is where our Credit
Card processing Bank was.
We had to go offshore to get a processor
to handle the CC's. We
even had to put up a 500,000 dollar
deposit in the bank of Antigua
before they would even start processing
for us. We processed a little
over one
million dollars in credit cards and we NEVER
touched the
money, it is still sitting
there.
AG - Hinted that Andy
was taking huge chunks of money in rebates.
Andy - My total rebates for the past year has
been about 54,000 dollars.
We have members making more than
that in a month, and that is what I
made in about a year. My salary
for the past year has been about
55,000 dollars.
The company was making a good profit
and I was not taking the money
out, I was letting it accumulate
so that we could get into other businesses
and create other income streams.
For example the T.V. Commercials
with Gary.
AG - Said that my representation
of meeting with and hiring SEC
Attorneys
was 'made up'.
Andy - That is another big
lie, I never said that. I have always said
that our attorney is an SEC Attorney
and he practices law in NC.
We had retained the Ackerman Attorney
Firm before the Miami rally
in May, and Robert Garner and I
met with Bill Schwartz who is in the
firm on the Monday after the rally.
We went over the program with
Bill so that he would be familiar
with it and asked for feedback on
anything that he might see that
we need to change.
Bill is also know as an SEC Attorney.
They I announced that we had
retained an Attorney Firm in Miami
that had 500 attorneys. And they
had a firm in Tallahassee and in
Washington,
DC. But I never said
that I had gone to Washington DC
to meet with attorneys.
They judge said today that she will give our
Attorneys a few days to
respond to the motion that was filed. They are preparing
a plan of action
for our start up. They are requesting a hearing with
the judge so they can
present the evidence why we are NOT a ponzi.
They will also present a plan of how we will start
up with government
supervision, we don't mind government supervision!
Andy went on to thank some of his staff that is putting
in a lot of hours
providing information for the Attorney's. They
are doing a great job!
